Licensing Windows Server 2012 Essentials - Need to purchase other products?

I placed an order for 1 unit of WSE 2012 with our local MS distributor on behalf of a client only to be told that the automated MS order process rejected it as incomplete because there weren't enough products included in the order to qualify for Volume Licensing (VL).

WSE comes with 25 user accounts and requires no CALs up to that number of accounts. I assumed that this meant that it automatically qualified for the VL program (at least for Open License). I have called Partner Support and been assured that this is correct. The distributor staff agree with me but say there is nothing they can do. They say, I, or rather, the client, has to include something else in the order to bring it up to 5 items which is the minimum for the Open License Program. Below is a quote from an email they received from MS.

"Please note that as per below screenshot the reason for rejection is that the order would need to be placed for 5 units which is the minimum quantity for Open License Program."

Is this correct? Has any other partner experienced a similar situation?
